Terms and Conditions

Please read these Terms and Conditions ("Terms") carefully before using the Half/Wit mobile application ("the App", "Half/Wit", or "the Game") operated by Half/Wit Games ("we", "us", or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not download, install, or use the App.

1. Overview of the App

Half/Wit is a multiplayer party game in which players respond to creative prompts and vote on each other's answers. The Game operates entirely through peer-to-peer Bluetooth Low Energy (BLE) communication between nearby devices. No internet connection is required for gameplay. The App is available on iOS and Android platforms.

2. Acceptance of Terms

By accessing or using the App, you confirm that you are at least 13 years of age (or the minimum age required in your jurisdiction) and that you have the legal capacity to enter into these Terms. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

3. License

We grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on a device that you own or control, strictly in accordance with these Terms and any applicable app store terms.

You may not:

• Copy, modify, distribute, sell, or lease any part of the App;
• Reverse-engineer, decompile, or disassemble the App, except to the extent permitted by applicable law;
• Attempt to extract the source code of the App;
• Transfer, sublicense, or assign your rights under this license to any other person;
• Use the App for any unlawful or unauthorized purpose.

This license is effective until terminated by you or by us. Your rights under this license will terminate automatically if you fail to comply with any of these Terms.

4. Game Content and Prompts

4a. Prompt Disclaimer

The prompts included in Half/Wit are creative, fictional, and humorous in nature. They are designed solely for entertainment purposes as part of a party game experience. No prompt in the App is intended to refer to, depict, or represent any specific real individual, company, organization, group, or entity. Any resemblance to actual persons (living or deceased), businesses, organizations, events, or locales is entirely coincidental and unintentional.

4b. Prompt Packs

The App includes a free prompt pack and optional expansion prompt packs available for purchase. All prompt content is created by Half/Wit Games and is provided as-is for entertainment purposes.

4c. Right to Modify Prompts

Half/Wit Games reserves the right to modify, replace, add, or remove any prompts included in the App at any time, including prompts contained in expansion packs that you have purchased. Changes may be made for any reason, including but not limited to improving game quality, correcting errors, removing content that may be considered offensive or inappropriate, or responding to legal or regulatory concerns. When you purchase an expansion pack, you are purchasing access to a curated collection of prompts as it exists at the time of each App update; the specific prompts within that collection are subject to change. Such modifications do not entitle you to a refund. We will make reasonable efforts to ensure that the overall quantity and quality of prompts in each expansion pack remain consistent following any changes.

5. User-Generated Content

5a. Player Responses

During gameplay, players submit text-based answers to prompts. These answers constitute user-generated content ("User Content"). You are solely responsible for the content of your responses. Half/Wit Games does not generate, endorse, pre-screen, review, moderate, or control User Content in any way.

5b. Content Responsibility

You acknowledge and agree that:

• You are entirely responsible for all User Content you create, submit, or transmit through the App;
• Half/Wit Games is not responsible for any User Content created by any player, including content that may reference, mention, or allude to specific individuals, companies, organizations, groups, or other entities;
• Half/Wit Games has no obligation to monitor, review, or moderate User Content;
• User Content is transmitted directly between players' devices via Bluetooth and is not stored on, routed through, or accessible by any server operated by Half/Wit Games;
• User Content exists only in device memory during an active game session and is automatically discarded when the game ends.

5c. Prohibited Content

While the Game is designed for humorous and creative play among friends, you agree not to use the App to create, submit, or transmit content that:

• Is defamatory, libelous, or constitutes harassment or bullying directed at any real individual or entity;
• Contains threats of violence or incites harm against any person or group;
• Violates any applicable law, regulation, or third-party rights, including intellectual property rights;
• Contains hate speech targeting any individual or group based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic;
• Is obscene or sexually exploitative, particularly content involving minors;
• Constitutes or encourages illegal activity.

Violations of this section are the sole responsibility of the user who created the content. Half/Wit Games disclaims all liability for User Content.

5d. Player Names

You may choose a display name for use during gameplay. Display names are visible to other players in your game session. You agree not to choose a display name that impersonates another person, is offensive, or violates these Terms.

6. Bluetooth Communication

6a. How It Works

Half/Wit uses Bluetooth Low Energy (BLE) for all in-game communication. When you play the Game, your device communicates directly with other nearby players' devices. The host device coordinates the game session, and all game data (prompts, answers, votes, and scores) is transmitted peer-to-peer.

6b. Permissions

The App requires Bluetooth permissions to function. On Android, this includes Bluetooth Connect, Scan, and Advertise permissions (and Location permission on Android 11 and below, as required by the operating system for BLE scanning). On iOS, this includes Bluetooth usage permission. You must grant these permissions for the App to operate. If you deny or revoke Bluetooth permissions, the App will not be able to function.

6c. Encryption

All peer-to-peer communication is encrypted using the Noise Protocol framework with Curve25519 key exchange and ChaCha20-Poly1305 authenticated encryption. Peer identities are verified using Ed25519 digital signatures. Despite these security measures, we cannot guarantee absolute security of wireless communications. You use Bluetooth communication at your own risk.

6d. Range and Proximity

Bluetooth communication has a limited range (typically up to approximately 30 feet / 10 meters). All players must be within Bluetooth range of the host device to participate. Game quality and connectivity depend on environmental factors, device hardware, and interference from other wireless devices. We do not guarantee uninterrupted or error-free Bluetooth connectivity.

6e. No Server Communication

The App does not connect to, send data to, or receive data from any external server during gameplay. All communication is local, device-to-device. No gameplay data is transmitted over the internet.

6f. Platform and Technology Dependency

The App relies on Bluetooth Low Energy (BLE) capabilities provided by your device's operating system and hardware. Half/Wit Games does not control and is not responsible for changes to the underlying Bluetooth technologies, APIs, or permissions made by Apple, Google, device manufacturers, or any other third party. If Apple, Google, or any other platform provider modifies, restricts, deprecates, or removes Bluetooth functionality, APIs, or permissions that the App depends on, the App may cease to function partially or entirely. In such an event, Half/Wit Games shall not be liable for any loss of functionality, and such changes do not entitle you to a refund of any in-app purchases. We will make reasonable efforts to adapt the App to platform changes where technically feasible, but we cannot guarantee continued compatibility with future operating system versions or hardware configurations.

7. In-App Purchases

7a. Expansion Packs

The App offers optional expansion prompt packs as one-time, non-consumable in-app purchases. The free prompt pack provides a complete game experience; expansion packs are entirely optional.

7b. Payment Processing

All purchases are processed through the Apple App Store (iOS) or Google Play Store (Android). We do not directly collect, process, or store any payment or financial information. All transactions are subject to the terms and policies of the respective app store.

7c. Refunds

Refund requests for in-app purchases must be directed to Apple or Google, as applicable, in accordance with their respective refund policies. We do not process refunds directly.

7d. Restoring Purchases

Previously purchased expansion packs can be restored at no additional charge through the App's restore purchases feature, which verifies your purchases with the respective app store.

8. Intellectual Property

8a. Ownership

The App and all of its content, features, and functionality (including but not limited to game design, prompts, artwork, graphics, logos, icons, audio, and software code) are owned by Half/Wit Games and are protected by copyright, trademark, and other intellectual property laws. The Half/Wit name and logo are trademarks of Half/Wit Games.

8b. Restrictions

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any content from the App, except as incidental to normal use of the App for personal, non-commercial gameplay.

9. Open Source Acknowledgments

Half/Wit incorporates the following open source software:

• Bitchat SDK — The App uses the Bitchat open source Bluetooth mesh networking protocol (github.com/BitchatProtocol) for peer-to-peer communication. Bitchat provides the underlying Bluetooth Low Energy transport layer, encryption, and peer discovery functionality used by the App. We gratefully acknowledge the Bitchat project and its contributors for making this technology available. The Bitchat SDK is used in accordance with its open source license terms.

Use of open source components does not affect your rights or obligations under these Terms with respect to the App as a whole.

10. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT;
• WARRANTIES THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS;
• WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY CONTENT OR GAME EXPERIENCE;
• WARRANTIES REGARDING BLUETOOTH CONNECTIVITY, RANGE, OR PERFORMANCE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL HALF/WIT GAMES, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:

• Your use of or inability to use the App;
• Any User Content created, submitted, or transmitted by any player;
• Any content that references, mentions, or is perceived to relate to any specific individual, company, organization, group, or entity, whether in game prompts or User Content;
• Any unauthorized access to or alteration of your data or transmissions;
• Any interruption or failure of Bluetooth communication;
• Any interaction between players during or arising from gameplay;
• Any other matter relating to the App.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE APP EXCEED THE AMOUNT YOU PAID TO US (IF ANY) FOR THE APP OR IN-APP PURCHASES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE EXCLUSIONS OR LIMITATIONS MAY NOT APPLY, AND YOU MAY HAVE ADDITIONAL RIGHTS.

12. Indemnification

You agree to indemnify, defend, and hold harmless Half/Wit Games, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable attorney's fees) arising from:

• Your use of the App;
• Any User Content you create, submit, or transmit;
• Your violation of these Terms;
• Your violation of any applicable law or regulation;
• Your violation of any third-party rights.

13. Privacy

Your use of the App is also governed by our Privacy Policy, available at halfwitgames.com/privacy-policy. By using the App, you consent to the practices described in our Privacy Policy. In summary, the App does not collect personal data, does not use analytics or tracking, and all gameplay data remains local to the participating devices.

14. Third-Party Terms

Your use of the App is subject to the applicable app store terms:

• Apple App Store: Your use of the App on iOS is subject to the Apple Media Services Terms and Conditions, including the Licensed Application End User License Agreement ("Standard EULA"). In the event of a conflict between these Terms and Apple's Standard EULA, Apple's Standard EULA shall prevail with respect to your use of the App on iOS.
• Google Play: Your use of the App on Android is subject to the Google Play Terms of Service. In the event of a conflict between these Terms and Google Play's Terms of Service, Google Play's Terms shall prevail with respect to your use of the App on Android.

14a. Apple-Specific Terms

If you downloaded the App from the Apple App Store, you acknowledge and agree that:

• These Terms are between you and Half/Wit Games, not with Apple Inc. ("Apple"). Half/Wit Games, not Apple, is solely responsible for the App and its content.
• Apple has no obligation to provide any maintenance or support services for the App.
• In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the App.
• Half/Wit Games, not Apple, is responsible for addressing any claims by you or any third party relating to the App, including but not limited to: (a) product liability claims; (b) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection or similar legislation.
• In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, Half/Wit Games, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of any such claim.
• Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
• You represent and warrant that: (a) you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country; and (b) you are not listed on any U.S. Government list of prohibited or restricted parties.

15. Multiplayer Conduct

Half/Wit is a social game designed to be played with people you know. By participating in a game session, you agree to:

• Treat other players with respect;
• Take responsibility for the content of your own answers and responses;
• Acknowledge that the game host has the ability to manage the game session, including removing players;
• Understand that other players' responses are their own and do not reflect the views or opinions of Half/Wit Games.

Half/Wit Games is not responsible for any disputes, disagreements, or negative experiences between players arising from gameplay.

16. No Affiliation Disclaimer

Half/Wit Games is an independent developer. The App is not affiliated with, endorsed by, sponsored by, or associated with any other individual, company, organization, or entity unless explicitly stated. References within game prompts to general concepts, scenarios, or hypothetical situations do not imply any connection to real-world individuals, companies, organizations, or events.

17. Termination

You may terminate your agreement to these Terms at any time by uninstalling the App from your device. We may terminate or suspend your access to the App at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your license to use the App will immediately cease.

18. Modifications to the App and Terms

18a. App Updates

We may update, modify, or discontinue the App (or any part of it) at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuance of the App.

18b. Changes to Terms

We reserve the right to modify these Terms at any time. Updated Terms will be posted on our website with a revised effective date. Your continued use of the App after any changes constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.

19. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising out of or relating to these Terms or the App shall be resolved through binding arbitration in accordance with applicable arbitration rules, except where prohibited by law. You agree to waive any right to a jury trial or to participate in a class action lawsuit.

Nothing in this section shall prevent either party from seeking injunctive or other equitable relief in court for matters related to intellectual property or unauthorized access to the App.

20. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

21. Entire Agreement

These Terms, together with the Privacy Policy and any applicable app store terms, constitute the entire agreement between you and Half/Wit Games regarding the use of the App and supersede all prior agreements and understandings, whether written or oral.

22. No Waiver

Our failure to enforce any right or provision of these Terms shall not be considered a waiver of that right or provision. The waiver of any such right or provision will be effective only if in writing and signed by a duly authorized representative of Half/Wit Games.
